Mr Christopher Malan is Executive Manager of the Compliance and Prevention Division at the Financial Intelligence Centre (FIC), the national financial intelligence unit in South Africa, with responsibility for monitoring the national state of supervision, and inspections, by supervisory bodies and status of compliance of accountable and reporting institutions, and affected persons, in terms of the Financial Intelligence Centre Act, 2001 (FIC Act).
Mr Christopher Malan holds the BA (Political Studies & Roman Dutch Law), LLB and LLM (Advanced Company Law & Maritime Law) degrees and Postgraduate Diploma in Tax Law (University of Cape Town), Postgraduate Diploma in Economic Principles (SOAS University of London), and attended the Program on the Global Financial System: Structure, Crisis and Reform (JFK School of Government, Harvard University). He is a former attorney, with right of appearance in the High Court, and a certified anti-money laundering specialist (Association of Anti-Money Laundering Specialists), since 2013.
Mr Malan led the consultations with the banks and casinos for reporting electronically cash threshold transactions to the FIC system to system, and the registration of all affected institutions with the FIC, with effect 01 December 2010. In 2016, Mr Malan led the consultation on the new FIC registration and reporting system (“goAML EE” platform), which went live in April 2016. Mr Malan has designed the strategic and operational framework for the public private financial information sharing partnership, comprising the FIC, Prudential Authority and banks, operationalised as the South African Anti Money Laundering Integrated Taskforce (SAMLIT), in December 2019.
In late 2004, Mr Malan transferred to the FIC from the National Treasury where he was the Chief Director of Financial Regulation, and had finalised the AML/CFT policy and regulatory regime, including stakeholder consultations on the draft FIC Bill, oversaw the passage of the FIC Bill through Parliament, and advised then Minister of Finance, the Honourable Dr Trevor Manuel, on the establishment of the FIC.
Mr Malan is a current member of the E-Commerce Advisory Committee to the Minister of Finance, and formerly represented the Minister of Finance as a member of the Standing Committee for the Revision of the Banks Act, 1990, and the Policy Board for Financial Services and Regulation.
Mr Malan, as financial sector expert, wrote the financial sector and supervision chapters of the FATF Mutual Evaluation Assessment of Australia in 2005, which was implemented by the Australian Government as the Anti-Money Laundering and Counter-Terrorism Financing Act 2006. He participated as the financial sector expert on the FATF Mutual Evaluation Assessment of Finland, which report was adopted by the FATF in February 2019.
